A Philadelphia state court jury has ordered Bayer and Johnson & Johnson to pay $27.8 million to an Indiana couple, Lynn Hartman and her husband, over the both companies’ failure to warn of Xarelto's internal bleeding risks.The jointly developed blood thinner has costs he companies $1.8 million in compensatory and $26 million in punitive damages.
Bayer and J&J have won three previous cases in federal court, making this case its first lost related to Xarelto.
Bayer said it believed there was no basis for the verdict and plans to appeal the verdict. J&J will also appeal the verdict.
The trial was the first of roughly 1,400 Xarelto cases pending in the Philadelphia court. Today there are more than 18,500 cases pending in federal court.
